If you do not make a Will, your estate will be distributed in accordance with the ‘Intestacy Rules’ set out by the Administration of Estates Act 1925. These rules mean that your express wishes will not be followed.
For example, if you wish for all your monies and assets to be transferred to your spouse or civil partner on your death, the Intestacy Rules dictate that only the first £322,000, plus one half of your remaining estate would go to your spouse/civil partner and the rest will be split equally between your children.
